Terms of Service
These terms govern your use of byoutoyou. Please read section 3 (what byoutoyou is and is not), section 8 (limitation of liability) and section 10 (arbitration) carefully — they affect your legal rights.
1. Who we are
byoutoyou ("byoutoyou", "we") operates a platform that connects patients and their families with independent, licensed beauty and grooming professionals ("Professionals") who visit patients in hospitals. By requesting a visit, browsing the directory, or otherwise using the site, you agree to these terms.
2. Who may use it
You must be 18 or older. If you request a visit for another person, you confirm that you have their permission, or the legal authority to act for them, and that you will tell them what has been arranged.
3. What byoutoyou is — and is not
- byoutoyou is a marketplace and coordination service. The Professional who performs the visit is an independent contractor, not our employee, and is solely responsible for the work they do.
- byoutoyou provides no medical care and no medical advice. Professionals do not move patients, handle lines, tubing or equipment, administer anything, or perform any clinical task.
- byoutoyou is not affiliated with, endorsed by, or acting for any hospital. Hospital records shown on this site come from the public CMS Hospital General Information dataset. Listing a hospital does not mean the hospital has a relationship with us.
- Every visit is subject to the hospital's own policy and the care team's approval, and may be refused, shortened or rescheduled by hospital staff at any time.
4. Professionals are vetted, not employed
Before a Professional may accept visits we verify their state licence, obtain a background check, and require proof of their own liability insurance. We train them on hospital etiquette, hand hygiene, isolation precautions and patient privacy. Vetting reduces risk; it is not a guarantee of any outcome, and it does not make byoutoyou the provider of the service.
5. Local matching
A visit is offered only where a Professional based near that hospital is available. Where there is none, you may join a waitlist. We do not send a Professional in from another region.
6. Requests, payment and cancellation
- A request is not confirmed until we have cleared it with the hospital unit and told you so.
- Your card may be authorised when the visit is confirmed; it is charged after the visit is completed.
- If the unit cancels, or the patient is discharged, transferred or unwell, you are not charged.
- If you cancel less than 4 hours before a confirmed visit, we may charge up to 50% of the price to compensate the Professional for the reserved time.
- If you are unhappy with a visit, tell us within 7 days and we will review it and may refund it.
7. Your responsibilities
- Give accurate information about the patient's condition and needs, including anything that affects safety (mobility, oxygen, isolation precautions, allergies, cognitive state).
- Do not send medical records, diagnoses or other clinical information — we do not want them and do not store them.
- Do not use the platform to arrange anything a hospital forbids, or anything clinical.
8. Disclaimers and limitation of liability
The platform and the directory are provided "as is". We do not warrant that hospital data is accurate, complete or current — it comes from a third-party government dataset and may be out of date.
To the fullest extent permitted by law, byoutoyou is not liable for the acts or omissions of any Professional, any hospital, or any third party; and our total liability arising out of or relating to the platform or any visit is limited to the amount you paid us for the visit that gave rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, in any circumstances.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our own negligence, or for fraud.
9. Privacy
We ask for the minimum a visit needs. See the Privacy Policy.
10. Disputes, arbitration and class-action waiver
Any dispute between you and byoutoyou will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Delaware or, at your election, your home county, rather than in court — except that either party may bring an individual claim in small-claims court.
You and byoutoyou waive any right to a jury trial and to participate in a class or representative action.
You may opt out of this arbitration agreement by emailing legal@byoutoyou.com within 30 days of first accepting these terms. Opting out does not affect any other part of these terms.
11. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.
12. Changes
We may update these terms. Material changes will be posted here with a new date, and will apply to visits requested after that date.
